Legal Surrogacy In Mexico

The basis for legal surrogacy in Mexico is formed by the 2021 ruling by the Supreme Court of Justice of the Nation. The Court ruled on a previous modification of the Civil Code of the state of Tabasco in 2016 to exclude non-heterosexual couples and foreigners.

The Supreme Court ruled that:

surrogacy is a legitimate form of family building and assisted reproduction
everyone has a right to a family
it is unconstitutional to discriminate against foreigners and different sexual orientations and family types
both altruistic and compensated surrogacy is allowed
that agencies can act as intermediaries in the process
